Empregador que comprar período integral de férias do trabalhador, mesmo a pedido do empregado, poderá pagar o valor em dobro. O direito às férias remuneradas foi uma das mais importantes conquistas dos brasileiros. No entanto, há quem prefira abrir mão do intervalo de descanso para aumentar a renda.
O advogado trabalhista, Carlos Henrique Matos Ferreira, explica que o trabalhador é proibido de renunciar as férias, já que o direito assegurado pelos artigos 129 e 130 da Consolidação das Leis do Trabalho (CLT) visa preservar a saúde do empregado.
“Trata-se de uma determinação legal e não mera opção. Caso haja a venda integral das férias, a empresa poderá ter que conceder novo período dentro de um ano, estando, ainda, sujeita ao pagamento em dobro e a sofrer penalidades administrativas”, diz.
Apesar de a lei determinar a concessão das férias em um só período após o cumprimento de um ano de trabalho, Carlos Henrique diz que o empregado tem a opção de fracionar suas férias em até duas partes, sendo que uma delas não poderá ser inferior a 10 dias. Esse limite mínimo também é válido como opção única para a venda das férias. Além do pagamento do adicional de um terço das férias vendidas, o trabalhador terá direito a receber os dias trabalhados durante as férias.
A secretária Adriana Rodrigues tem o costume de vender as férias no meio do ano. Com viagem planejada para Minas Gerais esse mês e para o Rio de Janeiro em abril, ela conta que programa o período de descanso de acordo com sua própria necessidade. “Meu trabalho é tranquilo e não vejo necessidade de tirar o mês todo. Esse dinheiro é só um terço a mais, mas eu financiei um apartamento recentemente e todo dinheiro que vier é bem vindo”, diz.
O especialista alerta que o tempo de descanso poderá ser reduzido somente em caso de faltas injustificadas. Os 30 dias corridos são garantidos em até 5 faltas e, caso esse número ultrapasse 32 dias, o empregado perde o direito a férias.
“De acordo com o 1º parágrafo do artigo 130 da CLT, é vedado descontar do período de férias as faltas do empregado ao serviço. No entanto, o período das férias será reduzido na proporção da ocorrência de faltas injustificadas, como não entregar o atestado médico, por exemplo”, explica Carlos Henrique.
O período de férias é determinado pelo empregador, que deverá avisar, por escrito, ao trabalhador com pelo menos 30 dias de antecedência para que ele possa se programar. Já o pagamento deverá ser efetuado em até dois dias antes das férias. O trabalhador que não receber as férias ou cumprir o intervalo fora do período concessivo de um ano poderá reivindicar a fixação das férias, podendo ainda, em casos extremos, pleitear a rescisão indireta por meio de reclamação trabalhista.
